Roulette Croupier Sues Employer 09.10.2011

Luke Phillips a 25 year old roulette croupier and card dealer from Carlisle in Western Australia had sued his employers at Burswood Casino after suffering injuries as a result of dealing cards and spinning the roulette wheel which was part of his job description.

It all started back in 2009 when Phillips was acting as a blackjack dealer and suffered shoulder and back injuries. The casino decided to move him to lighter duties and he was put in a small room where he had to split decks of cards and check them for irregularities.

Phillips stated “they had us in a little room. It was bad atmosphere and made you feel like you were drowning. It was demeaning… we had to keep up with the number of cards they wanted us to do each hour despite my shoulder and back injury.”

His condition was made much worse in April 2010 when he was moved to work as croupier at the American roulette tables. Bending over the roulette table has caused further strain on his shoulders and back and also caused problems with his feet and lower back.

Following the second injury Phillips found it difficult to stand and walk and was unable to return to work. The casino continued paying him a salary for additional 11 months after Phillips’s occupational physician and orthopedic specialists both claimed the injuries were work related.

However later on his occupational physicians changed their mind and started to doubt Phillips has any injury at all. The orthopedic specialists continued to claim there were injuries and they were work related.

Phillips was stranded with no money and real difficulty finding work that is suitable for his physical condition. He decided to sue the casino and received an out of court settlement of $35,000 Australian dollars.

Phillips’s representative said that the settlement was accepted not because they did not have a strong case against the casino, but because “his personal situation was dire without wages and the prospect of waiting months down the track for a court outcome was not realistic.”
